{"id":234439,"date":"2025-08-15T16:41:27","date_gmt":"2025-08-15T16:41:27","guid":{"rendered":"https:\/\/abianewscentral.com.ng\/just-in-canadian-court-did-not-declare-us-a-terrorist-organisation-apc-clarifies-ruling\/"},"modified":"2025-08-15T16:41:27","modified_gmt":"2025-08-15T16:41:27","slug":"just-in-canadian-court-did-not-declare-us-a-terrorist-organisation-apc-clarifies-ruling","status":"publish","type":"post","link":"https:\/\/abiaradiostations.com.ng\/news\/just-in-canadian-court-did-not-declare-us-a-terrorist-organisation-apc-clarifies-ruling\/","title":{"rendered":"Just In: Canadian Court Did Not Declare Us A Terrorist Organisation \u2013 APC Clarifies Ruling"},"content":{"rendered":"<p>Just In: Canadian Court Did Not Declare Us A Terrorist Organisation \u2013 APC Clarifies Ruling<br \/>\n<\/p>\n<div id=\"mvp-content-main\">\n<h2>The All Progressives Congress (APC) has dismissed reports that a decision of a Canadian Court allegedly declared the ruling party as a terrorist organisation.<\/h2>\n<p>In a statement on Friday, National Publicity Secretary of the APC, Felix Morka, stated categorically that the court did not declare APC as a terrorist organisation, contrary to \u201c<em>highly erroneous media reports in circulation.<\/em>\u201d<\/p>\n<p>The party stated that the\u00a0declaration was allegedly made in the case of Douglas Egharevba and the Minister of Public Safety and Emergency Preparedness, in which the Applicant (Douglas Egharevba) sought judicial review of a decision by the Canadian Immigration Appeal Division [IAD] which determined that the Applicant was inadmissible in Canada under its Immigration and Refugee Protection Act (IRPA).<\/p>\n<div class=\"code-block code-block-3 ai-track\" data-ai=\"WzMsMCwiSXNhYWMiLCIiLDRd\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLSd3GiRw0g6bOS3kAtHb1Yhc5Jic6iTkM9pA5DhIB13uZgDpGQ\/viewform?usp=sharing&amp;ouid=102633326415294296882\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1026109\" src=\"https:\/\/www.naijanews.com\/wp-content\/uploads\/2025\/08\/WhatsApp-Image-2025-08-09-at-16.23.48.jpeg\" alt=\"\" width=\"672\" height=\"560\"\/><\/noscript><\/a><\/div>\n<p>The party added:<em> \u201cIn a decision in the matter dated June 17, 2025, Judge Phuong T.V. Ngo dismissed the application for judicial review on the ground that the Applicant was a member of the Peoples Democratic Party (PDP) and that the PDP was an organization engaged in acts of subversion pursuant to paragraph 34(1)(b.1) of the IRPA making him inadmissible in Canada.<\/em><\/p>\n<p><em>\u201cIn his analysis, the Judge stated, \u201cAs such, applying the reasonableness standard of review, I cannot find the IAD\u2019s conclusion that the Elections in question constituted a democratic process or institution and that the PDP, its members and supporters engaged in subversive acts committed against the electoral process for the improper purpose of maintaining political power to be unreasonable.\u201d<\/em><\/p>\n<p><em>\u201cTo be clear, the only reference to APC in the entire 16-paged decision was in the introductory \u201cBackground\u201d, Paragraph 4, where the court referenced a \u201cBackground Declaration Form in which the Applicant stated that \u201che was a member of the People\u2019s Democratic Party [PDP] of Nigeria from December 1999 until December 2007, and a member of All Progressives Congress [APC] party of Nigeria from December 2007 until May 2017.\u201d\u201d<\/em><\/p>\n<p>The party stated that for the record, it was not in existence as of 2007, disclosing\u00a0that it was registered in 2013.<\/p>\n<p>The statement noted that the Applicant\u2019s claim of membership of APC as of 2007 is evidently false as he could not have been a member of APC that didn\u2019t exist at the time.<\/p>\n<p>It stated that for the avoidance of doubt, the court never made any determination on the question of terrorism in its decision.<\/p>\n<p>The statement continued: \u201c<em>In the Judge\u2019s own words: \u201cHaving found that the IAD\u2019s analysis on subversion was reasonable, this is sufficient to dismiss the application for review. *I will therefore refrain from anaylyzing the IAD\u2019s findings on terrorism.\u201d*<\/em><\/p>\n<p><em>\u201cClearly, reports that APC was declared as a terrorist organization by the Canadian court in this matter is patently erroneous, if not mischievous.<\/em><\/p>\n<p><em>\u201cThe court did not make such a declaration, and could not have done so as that would be an unjustifiable overreach, and a major breach of fair hearing, among other due process rights, given that APC was not a party to the proceedings. Such a decision would also have been of absolute irrelevance as being made without jurisdiction, and of no extraterritorial applicability or significance.<\/em><\/p>\n<p><em>\u201cWe urge our Party faithful, supporters and all Nigerians to disregard the reports as false and misleading.\u201d<\/em><\/p>\n<p><!-- CONTENT END 4 --><\/p>\n<hr\/>\n<p><span class=\"copyright\"><strong>\u00a9 2025 Naija News, a division of Polance Media Inc.
